（一）用人单位基本条件
1.Established in accordance with the law, with actual business premises, paying taxes in accordance with the law, paying social insurance, and no record of serious violations or dishonesty; The positions hired by foreigners should be those with special needs, suitable candidates are temporarily lacking in China, and do not violate relevant national regulations; The wages and salaries paid to employed foreigners shall not be lower than the local minimum wage standard
1.依法设立，有实际经营场所、依法纳税、缴纳社会保险、无严重违法失信记录；聘用外国人从事的岗位应是有特殊需要，国内暂缺适当人选，且不违反国家有关规定的岗位；支付所聘用外国人的工资、薪金不得低于当地最低工资标准。

（二）申请人基本条件
1.They should be at least 18 years old, in good health, without a criminal record, have a confirmed employer within the country, and possess the necessary professional skills or corresponding knowledge level to engage in their work

2.所从事的工作符合我国经济社会发展需要，为国内急需紧缺的专业人员。3.If there are other provisions in laws and regulations regarding foreigners coming to work in China, such provisions shall prevail

（三）外国高端人才（A类）
Foreign high-end talents refer to scientists, technology leading talents, international entrepreneurs, specialized special talents, etc. who meet the requirements of "high precision and shortage" and market demand orientation, as well as the requirements of China's economic and social development, as well as talents who meet the criteria for calculating points for foreign high-end talents. 外国高端人才是指符合“高精尖缺”和市场需求导向，中国经济社会发展需要的科学家、科技领军人才、国际企业家、专门特殊人才等，以及符合计点积分外国高端人才标准的人才。外国高端人才可不受年龄、学历和工作经历限制。具体见外国人来华工作分类标准（试行）。

（四）外国专业人才（B类）
Foreign professional talents refer to those who meet the guidance catalog and job requirements for foreigners coming to China and are urgently needed for economic and social development. They have a bachelor's degree or above and 2 years or more of relevant work experience, and are not more than 60 years old; For those who truly need to meet the standards of innovation and entrepreneurship talents, professional skills talents, foreign professional talents who meet the point scoring criteria, and those who implement intergovernmental agreements or agreements, restrictions such as age, education, or work experience may be appropriately relaxed. If the state has regulations for specialized personnel and government project personnel, their regulations shall prevail
外国专业人才是指符合外国人来华工作指导目录和岗位需求，属于经济社会发展急需的人才，具有学士及以上学位和2年及以上相关工作经历，年龄不超过60周岁；对确有需要，符合创新创业人才、专业技能类人才、符合计点积分外国专业人才标准的以及执行政府间协议或协定的，可适当放宽年龄、学历或工作经历等限制。具体见外国人来华工作分类标准（试行）。国家对专门人员和政府项目人员有规定的，从其规定。

（五）其他外国人员（C类）
Other foreign personnel refer to other foreign personnel who meet the needs of the domestic labor market and comply with national policies and regulations. Please refer to theification standards for foreigners working in China for details
其他外国人员是指满足国内劳动力市场需求，符合国家政策规定的其他外国人员。具体见外国人来华工作分类标准（试行）。
Approval is granted if the following conditions are met
（六）具备如下条件的，予以批准
1. Belonging to the scope of authority of the foreign work management department;
1.属于外国人工作管理部门职权范围的；2. Those who meet the above conditions for working as foreigners in China;
2.符合上述来华工作外国人条件的；3. The application materials are true, complete, and meet the requirements.
3.申请材料真实、齐全、符合要求的。
Approval will not be granted in any of the following circumstances
（七）有如下情形之一的，不予批准
1. The application materials are incomplete;
1.申请材料不齐全的；2. The application materials do not meet the requirements;
2.申请材料不符合要求的；3. The application materials are false;
3.申请材料虚假的；4. The applicant does not meet the working conditions for coming to China;
4.申请人不符合来华工作条件的；5. Other situations where it is not suitable to issue a work permit to foreigners in China.
5.不适宜发给外国人来华工作许可的其他情况。

There is no limit on the number of foreign high-end talents (Class A); Foreign professional talents (Class B) are restricted according to market demand; The number of other foreign personnel (Class C) shall be limited in accordance with relevant national regulations. 外国高端人才（A类）无数量限制；外国专业人才（B类）根据市场需求限制；其他外国人员（C类）数量限制按国家有关规定执行。具体数量限制可通过外国人来华工作管理服务系统查询。
