虽然kin是家属,friend是朋友,但两者的意思可是截然不同的。
Next of kin指最近的亲属。
在遗产继承法中,指按亲族关系法与血缘关系为死者最近的亲属,也指依法可以取得死者遗产的人。本术语不一定指血亲,也可指姻亲。
如:
Shipowners or their representatives must take measures for safeguarding property left on board by sick, injured or deceased seafarers and for returning it to them or to their next of kin.
(e) 船东或其代表应采取措施保护患病、受伤或死亡海员留在船上的财物并将其归还给海员或其最近亲属。
类似的表达还有近亲属close relatives。如:
One of the purchasers/transferees is a HKPR and all the other purchasers/transferees, irrespective of whether they are HKPRs, are his close relatives (parent, spouse, child, brother or sister) and none of them is a beneficial owner of any other residential property in Hong Kong on the date of acquisition.
其中一名买家/承让人是香港永久性居民,而共同 购买住宅物业的所有其他买家/承让人(不论他们是否香港永久性居民),均是该名香港永久性居民的近亲属(即父母、配偶、子女、兄弟或姊妹),而他们在取得住宅物业当日,并无任何一人是香港任何其他住宅物业的实益拥有人。
Next friend则指诉讼代理人。
指代理未成年人或因患精神病而无行为能力人提起诉讼的成年人,但他不是该诉讼的当事人,也未被指定为原告的监护人〔guardian〕。一般为原告的亲属,应对原告的诉讼行为和费用负责。
如:
These persons cannot legally act for themselves in civil proceedings and must bring / make or defend a claim in court proceedings through a third party, i.e. by his next friend or a guardian ad litem.
在法律上他们不能为自己在民事诉讼中行事,必须透过第三者(即诉讼代理人或诉讼监护人)提出法律程序或在法律程序中提出申索或抗辩。
